  1. Check whether the timeshare you have decided to purchase actually exists. This general rule is irrelevant in our project as our specialist check it in the first place. Before placing an offer on our website, we check with the exchange company, as well as our colleagues in the region, whether such a club exists, what categories and types of memberships are available there, and which exchange company the resort is affiliated with.   1. Make sure there are nothing outstanding on your chosen ownership, it is active, there is no mortgage against it, the ownership is not suspended or cancelled. In fact, if there is anything outstanding on maintenance the ownership transfer simply will not take place. The Management Company and the Trustee (Resort Trust Company) or the Notary will not allow it. However, we recommend that you request information about the status of the ownership from the management company before concluding a purchase and sale agreement with the buyer. As part of data protection, you will not be given this information on someone else's membership.   1. Set carefully the sequence of paying for the timeshare purchase and the ownership transfer. Thereby you would have the buyer and seller well protected.

    Payment first or ownership transfer first? We recommend the following sequence:

    • Signing a simple purchase agreement by both parties
    • Preliminary partial payment transferred from the buyer to the seller
    • Ownership transfer executed by the authorized party with the transfer fee covered paid by the buyer
    • Final payment for the timeshare upon receipt of ownership documents issued in the name the buyer

      

    It’s better to involve a third party (lawyers or specialists) who will provide the following important services:

    • They will draw up a tripartite agreement, according to which they will take the control for the ownership transfer on behalf of the buyer and the seller, control and transfer the funds from the buyer to the seller upon completion of the ownership transfer
    • Provide the escrow service themselves or thru the Resort Trustee or resort affiliated Notary (keep the buyer’s money while ownership transfer is in process)
    • Check and control the ownership transfer and receipt of documents by the new owner
    • Organize the transfer of funds to the seller immediately after receipt of the newly issued ownership documents in the name of the buyer.


    All European countries (UK & EEC members) have developed timeshare legislation, which, among many regulations covers the process of the ownership transfer and thus provides the protection of seller and buyer. If you have chosen a timeshare at a European resort, the procedure for the ownership transfer to the European legislation, and therefore will be protected by it.
